XAP CORPORATE SITE PRIVACY POLICY AND ITS EXCEPTIONS

Except as set forth below, personally identifiable data you enter on the XAP Corporate Site is not made available or distributed to third parties, except with your express consent or at your express direction. In particular, XAP will not give, sell or provide access to your personal information to any company, individual or organization for its use in marketing or commercial solicitation or for any other purpose, except with your express consent, at your direction, as is necessary for the operation of this site, or pursuant to one of the exceptions listed below.

EXCEPTIONS TO THE PRIVACY POLICY

There are limited exceptions to the XAP Corporate Site privacy policy. When required by law to comply with any valid legal process such as a search warrant, subpoena, statute, regulation or court order, XAP will supply such information as XAP reasonably determines, based on the advice of counsel, it is legally required to supply.

THE PERSONAL IDENTIFYING INFORMATION WE COLLECT

While you may use the XAP Corporate Site to learn about our products and services without disclosing any information about yourself, XAP may ask for personal identifying information from you including, but not limited to, your name, address, city, state, country, ZIP code, e-mail address and telephone number. XAP collects personal information from you in order to respond to your questions or requests for information, or to send you materials or information that you have requested. When you visit the XAP Corporate Site, your browser will automatically transmit to XAP's server the IP address of your computer and type of browser you are using. Although your browser transmits the IP address of your computer, XAP does not associate this IP address with any personally identifiable information regarding you. XAP does not collect any personally identifiable information other than what users submit and their browsers transmit.

MINIMUM AGE OF 13 REQUIRED

XAP will not collect any personally identifiable information from persons who are not yet 13 years old. If you are under 13 years of age, you can utilize those portions of the XAP Corporate Site that do not involve the collection of personal information from users.

WAYS IN WHICH PERSONAL IDENTIFYING INFORMATION MAY BE USED

Your personal identifying information may be used by XAP for the following purposes:

  • If you submit a query, comment or request to XAP via our Contact Us page, XAP may collect personal information from you in order to respond.
  • If you wish to subscribe to any newsletter we produce, we ask for contact information, such as your name and e-mail address. Your e-mail address will be used to deliver the newsletter(s) and information from our websites. It will NOT be distributed to others for commercial or any other purposes.
  • We may use your identifying information to help diagnose problems with XAP's server and to administer the XAP Corporate Site.
  • Summary data representing a compilation of aggregate data representing XAP Corporate Site users may be collected by XAP to analyze user behavior and improve the site. Such summary data DOES NOT CONTAIN PERSONAL IDENTIFYING INFORMATION.

COOKIES

MODIFYING AND DELETING YOUR INFORMATION

If you wish to modify or delete personal information from XAP's database, you may do so by contacting Customer Support.

AMENDING THIS PRIVACY POLICY

XAP may amend this Privacy Policy from time to time. Unless legal obligations require faster implementation, if XAP makes any substantial changes to this Privacy Policy concerning use of your personal information XAP will notify you by posting a message on the XAP Corporate Site homepage for at least thirty days. Thereafter, the new privacy policy will apply to all data previously submitted or subsequently submitted to XAP, unless such use if prohibited by law.
